EASTBOURNE MOTORHOME HIRE

TERMS AND CONDITIONS – AGREEMENT FOR HIRE


THIS AGREEMENT IS BETWEEN: Eastbourne Motorhome Hire (THE OPERATOR) and you (THE HIRER)


  1. YOUR CONTRACT WITH EASTBOURNE MOTORHOME HIRE

    1. By signing this agreement you are accepting the terms and conditions in this hire agreement.

    2. If there is anything you do not understand, please ask before signing.

  2. BOOKING CONFIRMATION AND PAYMENT

    1. An initial part payment of £200 per vehicle is required to secure the booking and is non refundable. The balance of your hire money is payable 28 days prior to the hire period commencing.  

    2. A security deposit of £1,000 is required and must be paid at the same time as the balance of your hire money. This is held against any loss or damage to the motorhome (externally or internally).  In addition you agree to pay any and all costs for repair or damage to the motorhome, including insured excess costs and the full cost of uninsured damages.

  3. CANCELLATIONS

    1. All cancellations must be notified in writing or email to Eastbourne Motorhome Hire. If notification is received more than 28 days before the start date of the hire you will be refunded in full, less the £200 initial payment.

    2. If notification is received less than 28 days prior to the hire period the money is not refundable and you will be liable for any unpaid sums up to full contract price.  However Eastbourne Motorhome Hire will endeavour to rehire the vehicle and if we are able to do so you will be refunded the full amount less the £200 initial payment and subject to the amount we are able to rehire the vehicle for.

  4. COLLECTION AND RETURN TIMES

    1. The vehicle will only be released at the start time stated on the insurance document.

    2. The vehicle must be returned before the time stated on the insurance document Failure to comply with this will result in the forfeit of the security deposit. You will be uninsured and will be liable for the whole cost of the vehicle should you be involved in an accident. You would also be liable for prosecution under the Road Traffic Act.

  5. AVAILABILITY

    1. Occasionally the vehicle may not be available due to reasons beyond our control. If your booking has to be cancelled (which we reserve the right to do) we refund all monies paid for your booking. We will not be responsible for any costs or expenses or pay any compensation for reasons that are beyond our control.

    2. You are responsible for obtaining holiday insurance to cover this eventuality.

  6. SUITABLE PERSON

    1. Eastbourne Motorhome Hire reserves the right to refuse to hand over the vehicle to any person who, in our reasonable opinion, is not suitable to take charge. In such cases no refund of the hire charges will be made by Eastbourne Motorhome Hire, and we will accept no further liability.

    2. It is the hirer’s responsibility,  from the point of handover to ensure the vehicle is operated in a legally compliant, safe and responsible manner and to ensure that all the terms and conditions of the insurance are adhered to.

  7. PETS

No animals are permitted in the vehicle at any time. Failure to comply with this will result in the forfeit of the security deposit.

  1. SMOKING

No smoking is permitted in the vehicle at any time. Failure to comply with this will result in the forfeit of the security deposit.

  1. RENTAL PERIOD

You will have the vehicle for the agreed rental period. Failure to return the vehicle on time will constitute a breach of this agreement. You will be liable for a charge of the daily hire rate plus 50% for every day or part day that you overrun the hire agreement period.

  1. YOUR RESPONSIBILITIES

    1. You are responsible for the security and safety of the vehicle at all times during the hire period. You must not drive the vehicle 'Off Road' other than for reasonable access to a campsite. Should you become stuck at any time while 'Off Road' you will be responsible for any recovery costs. The breakdown cover is for roadside assistance only.

    2. You must comply with the legal requirements of the country in which you are travelling.

    3. You are responsible for all fines and other legal charges, including parking fines, speeding fines, the full cost of any fees associated with the vehicle being impounded and on the spot fines.

    4. You are responsible for all keys that belong to the vehicle. Lost keys are expensive and are not included as part of the breakdown service. You will be responsible for the full cost of replacement cost of lost keys and replacement of any locks if required. You will also be liable for the full cost of repairing any damage caused by forced entry of the vehicle.

    5. You must not sell, rent, lend or dispose of the vehicle or any of it parts, you must not give anyone any legal rights over the vehicle. The vehicle remains the property of Eastbourne Motorhome Hire at all times.

    6. At the time of handover the vehicle will be in a documented roadworthy condition. You must maintain the vehicle in a roadworthy condition at all times. Should you need to make any repairs to achieve this you may do so up to the maximum of £100 without any further permission. Any repairs in excess of £100 must be agreed with Eastbourne Motorhome Hire prior to carrying out the work. You will receive a full refund for any such approved repairs on production of a valid receipt.

    7. You are responsible for using the correct fuel in the vehicle. Using the wrong fuel is not covered by the breakdown service and you will be liable for the full cost of any remedial repairs required as a result of using the wrong fuel.

    8. You are responsible for returning the vehicle in a reasonable state of cleanliness. At our absolute discretion a charge of £50 will be made for anything other than standard cleaning.

    9. You are responsible for the full cost any damage or loss, internally or externally, to the vehicle. Any such damages or losses should be reported to Eastbourne Motorhome Hire at the earliest reasonable opportunity.

  2. CONDITIONS FOR USING THE VEHICLE

    1. You or any member of your party must not use the vehicle for hire or reward or for any illegal purpose or use the vehicle while under the influence of alcohol or drugs.

    2. Any person traveling in the vehicle must be seated in a designated seat and must use the seatbelts provided.

  3. ACCIDENT

    1. Eastbourne Motorhome Hire will accept no responsibility for any loss, damage or expense  which occurs as a result of any accident within or outside the vehicle or due to any mishap whilst using equipment associated with the vehicle.

    2. Eastbourne Motorhome Hire accepts no responsibility for any loss, damage or expense caused to any of your personal property in the motorhome.

  4. VEHICLE OWNERSHIP

The vehicle remains the property of Eastbourne Motorhome Hire at all times and we may repossess the vehicle at any time without further notice if you are in breach of this agreement.

  1. GOVERNING LAW

This agreement is subject to the laws of England and Wales. Any disputes not resolved by mutual agreement may only be settled in the courts of this jurisdiction.
